Spilt PILT

The city's saga over the underpayment of Colorado Springs Utilities payment in lieu of taxes (PILT) appeared to have ended in 2009, when Council sided with its auditor and told Utilities to fork over $4.3 million.

But apparently, it didn't.

At Monday's City Council meeting, City Attorney Patricia Kelly said she thought it might be illegal for Council to force Utilities to pay, because it might be considered "retroactive rate making." She advised the city to forget about the money it was owed from 2008, and consider whether or not to pursue the 2009 underpayment only after hammering out the implications of Douglas Bruce-authored Issue 300, which may or may not phase out PILT.

Council agreed to her terms.
