The news came in an unexpected, two-part serving Tuesday afternoon as Colorado Attorney General John Suthers personally delivered his opinion on how a possible sale of the city-owned Memorial Health System and how it might be affected by 12-year-old state legislation.

Suthers, asked to give his opinion to the citizens commission reviewing Memorial's ownership and governance, told the commission that he has determined the local system is indeed a nonprofit. In other words, if the city were to sell Memorial to a for-profit entity, all proceeds would have to go for the hospital's initial charitable purpose, health care.
However, the interpretation seemed to indicate that if Memorial were sold to a nonprofit, the city might be able to decide how to use the revenues.
The commission is months away from making any recommendations.
