Lathen and May: More than meets the eye?

Dan May clearly wants the cities and counties in his Fourth Judicial District to vote on a medical marijuana center ban.

The DA has made appearances at City Council meetings in Fountain and Colorado Springs. He's debated two Springs City Councilors, and made media appearances in which he's made arguments of questionable veracity in his effort to see a ban question.

In his travels, he's appeared multiple times before the El Paso Board of County Commissioners. Most recently was Aug. 12, in which he gave a variety of statistics to the board to persuade them to add a ban question.

First, though, Commissioners had to debate a "grandfathering" idea, which would have allowed existing MMJ centers to continue operation even in the face of a ban. This delayed the decision until Aug. 26, when Commissioners did choose to put the ban question (without the grandfathering clause) on the ballot.

The delay clearly got under the skin of Commissioner Amy Lathen. Check out this Aug. 13 e-mail to May, which the Independent obtained through a Colorado Open Records Act request:

Dan,

Yesterday was exceedingly frustrating. I am very disappointed and personally apologize that I was unable to achieve a majority vote to get this on the ballot.

It is by no means over however, and I will work aggressively within the next two weeks to deal with this grandfathering issue which was raised late in the discussion yesterday and I fully expect a ballot question by the 26th. I have the commitments I need, but I am not confident in whether or not I will be able to prevent the grandfathering. ...

My sincere apologies for a frustrating and unproductive outcome — at least for the time being. I hope we might talk about this prior to the next meeting.
