Confused by the constant legal wrangling in the recall election?

We seriously doubt you're alone. The El Paso County Clerk's Office is hoping to clarify two issues that came up today. First, is the fact that Libertarian Jan Brooks didn't make the ballot. Second, is that the Colorado Supreme Court ruled that voters can fill out any part of the recall ballot and still have their vote count.

Brooks Qualifies Only as Write-in Candidate
Colorado Supreme Court Clarifies Voting Standards

[Colorado Springs, Colo. – Aug 27, 2013] Earlier today the Colorado Secretary of State quickly determined the status of additional successor candidate petitions turned in to his office yesterday. While Libertarian Party candidate Jan Brooks’ petition to appear on the ballot was deemed insufficient, Brooks did qualify as a write-in candidate. As such, voters must write in her name in the “write-in” portion of the successor candidate ballot in order to vote for her. Jan Brooks also could protest the signatures deemed insufficient by the Secretary of State over the next five calendar days.

“We appreciate the Secretary of State doing his part to verify the signatures turned in yesterday and allowing my office to proceed with the production of ballots,” said Clerk and Recorder Wayne Williams.

With the Colorado Supreme Court’s decision that voters do not have to vote on the recall question to vote on the successor candidate question, the ballot production should be completed on schedule for voting to begin on September 5, 2013.

“While the changes to this election have been challenging at times, the decision today provides clarity to voters and my staff,” stated Wayne Williams.

As a reminder, only voters that reside in Senate District 11 by Election Day are eligible to participate in the Recall Election. Any voters that question whether their residence is within Senate District 11 can verify their status at www.GoVoteColorado.com.
