Although I doubt Mr. Pico intended to violate the city's Code of Ethics, the Ordinance is succinct. Language includes "perceived," "appearance of a conflict," "remote," and "indirect." It's pretty comprehensive, and council made it that way purposely when it was first adopted in 1994 and amended in 2009.
Mr. Pico will have to recuse himself from hearing or voting on all future annual budgets that include anything related to Fleet Management. Additionally, he will have to recuse himself from any discussions where employees of Fleet Management are involved, including salary considerations, benefits, labor disputes, etc.
The city has been down this road before, as have I as a former council member with a very similar circumstance. Bottom line: elected and city officials do not contract work with the city. The city has already opined that "recusal" and "disclosure" does NOT remove this matter from conflict. The city chose to adopt a Code of Ethics that is stricter than what the state requires. As such, the city (including the city attorney) is obligated to abide by the provisions spelled out in the Code of Ethics.
I never thought I would agree with the Dougster on anything, but he and Collins are right this time. The Mayor thinks of himself as the second coming of JFK. Along with Queen Suzi, he struts his stuff with a coterie of cops surrounding him. Another brain dead Council sheepishly does whatever His Royal Highness wants. The more things change, the more they get worse in C-Springs.

This is great work. It provides local insights into a national story, tells us about Myers the man, Sanford FL, the former police chief there and the complexities of the African-American issue in that area. In the process, it also shows the folly of the CS mayor in refusing to work with Myers.

He thrives on attention which is very apparent when he comes into city offices or CSU. "Both Pico and the mayor's chief of staff maintain that Pico has recused himself from all conversations regarding fleet changes...Once I was elected, I made sure Colorado Springs city administration was also aware," said Pico. "Talked to the city attorney, made sure everything was fire-walled and that I was isolated from anything to do with the contract...Chief of Staff Laura Neumann said Pico had nothing to do with the city's decision.
"The process started long before Andy Pico ran for council or certainly was elected for council," said Neumann. "So the process was well underway, the short list was well underway. And he had no influence whatsoever in our decision."

FEDEX and WalMart have moved their data centers here for a reason. Not just our low electric utility rates, but our cool and dry climate requires far less cooling effort for warehouses full of servers. Omaha is neither cool nor low in humidity.
FEDEX has moved about 2/3 of its data center ops (not "call" center ops) from Memphis to here and in the near future will complete the move of all data center ops to their campus at Voyager and NorthGate. These are GOOD jobs.
If Mayor Botch commits the crime of selling CSU to for-profit utility greedsters, our electric rates will skyrocket and this city will lose a key reason for data centers to come here.
I wonder what if anything the RBA, CofC, et al, are doing to get data centers to come here.

I would encourage everyone to read the internal, independent report compiled by Mountain States Employers Council, Inc. on Ms. Burbach's misdeeds (released 6/7). There is overwhelming evidence of procedural misconduct and personal antagonism of those who didn't happen to agree with her. The report concludes (and these are their words, not mine) that her denials only further damaged her credibility. Don't feel sorry for her. This should have happened a long time ago. The State of Colorado and the Toxicology Lab will be a much better place without this underqualified bully.
