Re: “Insult to injury

I have re-read the Colorado law reguarding the mis-representation of a service animal and I apoligize that I had my information wrong.. The intentional mis-representation of a service dog by anyone is a class 3 misdemeanor, not a felony as I had wrongfully stated in a previous post...

Re: “Insult to injury

To: Mr. “Man-in-Charge”

I really do appreciate the fact that your “special events go way above and beyond “ALL of the requirements that the A.D.A. has placed on you.
Again you state that you concur with A.D.A. rules. I was not aware that they were just rules. I thought they were laws. Federal laws. You make it sound as though they are just guidelines .The laws are not in the least bit vague to those of us who live by them. You state that the “laws” have not caught up to the times.
Please enlighten us as to how that could possibly be. They were reviewed, revised and updated and put into effect just this year. Perhaps you mean that they don’t conform to how you would like them to be. Maybe they could be tweaked to fit YOUR personal needs. Good luck with that one dude. There are many types of service animals, all of which serve a useful purpose for the individuals needs. Emotional and mental health animals don’t qualify as a service animal. In order to lawfully own a Service animal one has to be disabled as determined by the Social Security Department.(in case you don’t know it, they are a branch of the federal government).
You state that CSPD is not to blame for a lack of training as there is little information to train with. WTF are you talking about. Any fourth grader can tell you all you need to know about a service animal. All you have to do is GOOGLE ADA and look at the section regarding service dogs. It’s a short easy read that I am sure any police officer could understand it without to much trouble. REALLY.

And just what the HELL constitutes a legitimate service dog trainer? The FEDERAL law states that a service dog is “INDIVIDUALLY TRAINED”
Your words “ it is clear that the noise, crowds and confusion at A LARGE SPECIAL EVENT LIKE TERRITORY DAYS greatly impairs the service dogs ability to perform, rendering many dogs useless to detect seizures and allergies as they go on sensory overload. Who is it clear to? Where did you hear this? From a legitimate service dog trainer? You also state that by all accounts, a service dog performs best in a controlled and calm environment. Really? I would like to see something to back that claim up. Most service animals I know of Thrive in any environment with their handler. And I have known quite a few in the last 6 years of being disabled. How many have you personally interacted with?
And since you couldn’t help but “wonder” why I don’t carry some type of IDENTIFICATION for my animal, Well it’s because I am not legally required to do so. Why should I? Anybody can get a card that says anything they want it to say. It’s not the dog that’s disabled. AS you stated Anybody can simply state “mine is a service dog” and anyone can get an ID card also, And the signs leading to the event said nothing about “NO DOGS ALLOWED” it stated “NO PETS ALLOWED” and my animal is not a pet that does cute tricks. She is a highly trained animal that performs tasks that help to make my life a little more enjoyable and safer.
YOU also state that “any reasonable person can see that the police and “ my security staff MUST ask for such proof of a service animal.” You also state that “this is not a matter of law“. Just who in the FUCK DO YOU THINK YOU ARE? This is a matter of federal law.
Let me speak of what you call obvious irony.
I don’t mark my animal because as a matter of federal law I am not required to do so. Not for the police, not for the mayor and certainly not for you or your staff. I would have not had to as you put it “showcased myself “ “my dog” and “my case” if the CSPD knew the law and had complied with it as I did..
And in closing I speak directly to you, you who apparently thinks he’s above the law. Should you or your staff ever violate my CIVIL RIGHTS by making up your own custom set of rules, BE forewarned as to what options are available to me if you should violate the law and piss me off.. I promise to make your little puissant life a living nightmare. I will File the proper title complaint form with the branch of government that oversees the AMERICANS WITH DISABILITIES ACT.. It is called the UNITED STATES DEPARTMENT OF JUSTICE, The branch that investigates these complaints is called THE FEDERAL BUREAU OF INVESTIGATION. The COLORADO STATE ATTORNEY GENERALS OFFICE, will also receive copies of my legal complaints, as will the COLORADO SPRINGS CITY ATTORNEY, because the STATE of COLORADO also has LAWS governing service animals an disabled people. So mister self proclaimed “man in charge” I can only hope for your sake that you never violate my CIVIL RIGHTS, because I now have proof that your illegal actions won't be due to not knowing, but rather just not caring..

Jeff Scott first off jim, I commend you on the wonderful event... I have attended almost every year since its inception in 1979 when it was in the park and encompassed 1 block..

Jeff Scott now I will be addressing your statements reguarding the issues at hand.. 1 at a time

Jeff Scott first: the papers stated the no dog policy...The signs entering the park said no pets allowed NOT NO DOGS ALLOWED... As you are aware by now a service animal is not a pet by definition of the ADA

Jeff Scott second: My animal is fully house broken and is trained to deficate on command.. I have her relieve herself before ever embarking on a journey of any kind.. I also know the laws reguarding owners responsibilities relating to dogs having accidents... I do carry bags to be compliant with the law...

Jeff Scott Third: as far as my animal tripping people.. she walks close quarters to me at all times on a special harness.. I couldn't begin to tell you about all the toddlers I saw on 4foot leashes dropping ice crem and funnel cakes and soda pop on the ground... not to mention the disgusting people spitting chew everywhere.

and Jim the ADA laws are up to the times.. they were re-evaluated this year..and the wording is quite simple... It sounds as though you want me to dress my dog up so everyone knows I'm drawing Social Security Disability Insurance..As you know there are no requirements to do this for a reason... I firmly believe one of the reasons is to protect the disabled from attitudes such as yours...(MY PERSONAL OPINION...FOR WHAT IT'S WORTH.)

Jeff Scott i DO agree with you that people should not bring their pets to such an event.. pets aren't service animals and PETS do tricks...my animal performs tasks...

and just who do you believe is responsible for the lack of training to our men in blue reguarding service animals... The law is extremely clear... even my grandchildren understand it... as do most fast food restaurants, gas stations, supermarkets, airlines, zoos, wal-mart employees, starbucks barristas, childre bove the second grade and probably at least 75% of the individuals that are employed in jobs that deal with the public... come on JIM... don't you think the police are capable of understanding three simple questions that the Department of Justice has given them permission to ask... It's not that hard.....really...

Re: “Insult to injury

I almost forgot... I don't possess a service dog vest...why should I?... There is no place in the WORLD to register or certify your animal that the federal government recognizes, sponsors or maintains... The I.D. that I possess that identifies my animal can be bought from any place that has a printer.. It is not a legal document... A service animal can only be called a service animal if the handler is legally disabled... Perhaps The Federal government should issue I.D. cards that define us as disabled (I hate that FKN word) and different... I am open to suggestion as long as I don't have to paint a Bullseye on myself or my dog that Identifies us as "Special"... I guess I will need to start carrying around the 40 or 50 pounds of X-rays and the 30 or so boxes of medical documentation to show that I'm LEGAL.......... Ask me, Don't tell me...

Re: “Insult to injury

People who say they are "disabled" and that their pet is a "service animal" are comitting a felony...
I am not required to alter my animal to look like it has a disabled person attached to it and I refuse to do so... I am not sure why it is, but I feel like less of a man when I hear people call me "handicapped" or "disabled"..(I am a proud man) First off it is not anybodys concern, problem or business reguarding my healthcare issues.. I read this article and now I'm feeling like I should have just kept my mouth shut and continued to tolerate the abuse I receive.. I have no agenda, no underlying plan, no real animosity...I just want to lead the remainder of my existance as low key as possible... My real issue is that when I go somewhere (my animal is with me 24/7) one of three things normally occur, I am either asked if Candy is a service animal (which is how it should be) or I am TOLD I am not allowed to bring my DOG in (which is an unlawful statement) or nothing is said (which is usually the case)..People tell me all the time that they can tell my animal is working just by looking at her..(I guess she looks employed)..lol..
My whole point to speaking with this reporter (I also spoke to a CSPD officer attached to Internal Affairs) was to ask what I should do if I, or my medical device (re:CANDY) happens to be assaulted (so far it's only been verbal abuse, and that's rare) and I am forced to seek assistance from the police, Most of whom don't know the ADA.. Should I have to be berated and held accountable for teaching others the law... Out of more than 12 CSPD officers and police explorers that approached me at territory days, only 2 asked if Candy was a service animal.. 5 threatened me with either a ticket, expulsion or arrest...The Animal Welfare Officer that attended the event was appaled that I was treated like that... Why should I have to feel threatened and fear injury because peole don't know the law? PLease explain to me why I should be held accountable for teaching a federal law that has been around since 1990 to anyone...I have always been nice and extremely tolerant of those that don't know, But now I will be less tolerant and less nice to those that are rude, demeaning and pretend to know the law better than I... I have a lot of time on my hands these days... Like I said, get in my face (inappropriately) and I WILL get in your life.. I really do have better things to do in my life than send Title II and Title III complaints to the Department of Justice, The Colorado state Attorney Generals office, The Colorado Springs City Attorney and to your employer, but I think I will find the time to do so in the future... Dis-allowing my service animal access to any place that the general public is allowed is a CIVIL RIGHTS violation...... And just to set the record straight bmused, my goal is to be left alone...tyvm.

Re: “Keg Lounge

My dad (Scotty) owned the Keg for 20 years before Mud bought it and I must say the food now is 1000 times better now than it ever was... It is a neighborhood bar and they don't take kindly to being hasseled... Even if you're right, it don't matter...
there's plenty of other good neighbor bars all within walking distance of the Keg...
try one of them next time...
