Don't count out Bruce just yet

Dougie Goes Down … or does he?

We may think that the final act is underway, that Douglas Bruce is about to join jailbirds past and present in the slam. This time, he won’t wiggle free! This time, he’s not toying with City Clerk Kathryn Young. As Broncos linebacker Tom Jackson so memorably said to Oakland Raiders coach John Madden in a 1977 game, “It’s all over, fat man!”

This is tax evasion! This is fraud! Bruce is messing with Attorney General John Suthers! And can the IRS be far behind?

Not so fast.

Remember the great lyrics from “Hotel California”?

“They stabbed it with their steely knives
But they could not kill the beast.”

Here are the informal thoughts of one of our city’s leading attorneys, who must remain anonymous.

“Doug does have a major headache, but I am not sure that the State's case is as strong as it thinks it is. The indictment appeared a little disjointed to me. Does the State have evidence that Doug actually received the interest, pocketed it and then didn't report it? If so, then why didn't the indictment expressly state that? And if that is the case, then why aren't the IRS and the US Attorney after him? In other words, is the State imputing interest to Doug and using that as the basis for its case? But these alleged crimes are intent crimes, as opposed to strict liability offenses, so how can you get knowledge or intent out of imputed interest? I wouldn't count 'The Dougster' out just yet; he can be a hard one to box in.”

Doug’s not poor, so he may even hire Denver attorney Pamela Mackey to represent him. Mackey represents embattled Colorado Springs developer Ray Marshall, who faces a 33-count indictment on multiple charges of fraud, conspiracy, and theft, and violations of the Colorado organized crime control act.

She successfully represented Kobe Bryant, who was accused of rape some years ago.

Mackey, it is said, is the criminal lawyer whom you call when caught emptying your revolver into the quivering corpse of your business partner, from whom you’ve just embezzled a million bucks. Not only will she get you off, she’ll sue your erstwhile partner’s estate for another million bucks … and most of it will go to pay her fee!
