Yes, the people who ordered them to unlawfully notarize the forms are guilty of a crime, to wit:

18-8-306. Attempt to influence a public servant.
Any person who attempts to influence any public servant by means of deceit or by threat of violence or economic reprisal against any person or property, with the intent thereby to alter or affect the public servant's decision, vote, opinion, or action concerning any matter which is to be considered or performed by him or the agency or body of which he is a member, commits a class 4 felony.

And they SHOULD be charged with the above crime. Coercing a public servant, which a Notary is, to perform an unlawful act out of fear for their jobs is a perfect example of why the above statute was written. But.... will anyone in a position of authority do anything about it? That is the problem here. People seem to just get away with everything.

You probably remember when Maketa's scandal blew up. Everyone noted that there were signs of problemS, even an article here on the Independent a year prior, and everyone asked "Why was nothing done earlier?" Well, people should ask themselves that exact question today. There are plenty of signs that things are evil at the Sheriff's Office.

My guess is that the people who ordered the notaries to sign are guilty of some crime. Holding out something of value to force a public officer to exercise his duties unlawfully is probably some sort of corrupt influencing or public intimidation . The notaries should have refused, taken the consequences, and sued the ever-lovin' out of the sheriff and his corrupt-influencing , public intimidating staff. I'd say the sheriff and his staff are guilty if there is a criminal statute on the books dealing with their behavior in this case.

It seems all that which Pam Zubek has so excellently reported (as is usual for her) will be ignored by those being exposed.
This truly proves to me the wrong folk are controlling COUNTY OF EL PASO inc., with the "elected" puppets doing as their handlers direct them. Satan's municipal corporate system of governance needs to be dissolved ASAP, as it is clear they won't follow their own statutory policies and will fake whatever is necessary to continue the plunder of the populace.

@MikeRandall ... Dan May is just as bad as Bill Elder. They are a match made in ... well, I think you know where I am going with that one! It's a shame that the elected "leadership" in this county is so corrupt. It is quite sickening.

As so many of us know, Bill Elder actually has a black heart. He is driven by evil. He began to show his true colors when he and his boy band started their crap late 2013 before he even took office, but so many thought he was the almighty savior and here today we see another example that he is nothing more than a corrupt demon. He can't run forever. He can't continue to hide in the shadows or point the fingers at others and watch them take the fall. Regardless to the fact that he is an old fat guy, I can assure you, he cannot out run Karma.

How can anyone believes the El Paso County Sheriff's Office would changed if you elected a New Sheriff and he allowed the leadership of former Sheriff's Maketa to remain.Former Sheriff Maketa was not along in the alleged corruption within the El Paso Sheriff's Office.

Anyone who has served in a leadership role is aware of, if not all, most things the person above them is doing, especially if its been going on for almost twelve (12) years.

Most of Maketa's Senior Staff, Joe Breiste, Undersheriff, Bureau Chief Mitch Lincoln, Commander Rob King, Commander Tom DeLuca and Maketa's assistant, now Media Service, Jackie Kirby are still employed with the Sheriff's Office at their current position or has been promoted.

I believe the current situation at the Sheriff's Office is, Same Pig, Different lipstick. The alleged corruption you are seeing comes from the same old play book of the past. The same folks that played on Maketa's team is again playing on Sheriff Elder's team and corruption is in their DNA.

In the defense of Sheriff's Elder, I think he's a good guy, his heart is in the right place most time, but you can't keep the same folks that supported corruption under Maketa and expect them to change under your leadership.

The citizens of El Paso County are setting themselves up for a bigger scandal than Maketa's days. If the County Commissioners walk around with their head stuck in the sand, then you the citizens will donate again to potential legal actions.

Citizens and County Commissioners you can't defend those actions this time by stating you were not aware, Maketa left you with all the warning sign.

Several citizens have been disappointed the comprehensive audit promised by Sheriff Elder during his campaign has not been released. It's as if there was never an audit completed. The public tax paying citizens would like to know.

@Asher777, Going to be hard to lock him up when the local DA is bad too. This will be Dan May's defining moment. Either he ignores this and shows he is just as corrupt, or he steps up to the plate and goes after this and shows he has a little tiny bit of integrity. I'm guessing he will take the low road and cover it up.

By the way, does everyone remember the big KRW survey that was done on the department when Elder took office? And was released to the public? He had another one does this year. But.... no release or even a mention this time. Why not? The employees didn't say much the first time. But this time, they did. A lot. And the biggest theme was that the command staff were inept and corrupt and needed to go. No way Elder is going to release that one!

First and foremost, Rick Dietz is a good man and I commend him for speaking up and doing the right thing! It isn't easy, but he showed strength and integrity.

Piece by piece Bill Elder's corruption is being exposed. All along so many of us, including those behind DirtyElder.com, have been diligently working to expose the corruption that exists and continues to breed within the Sheriff's Office. All along there have been clear warning signs that corruption was the foundation of Bill Elder's platform for Sheriff especially when he surrounded himself with the likes of Larry Borland, Bill and Janet Huffor and Jackie Kirby. Come on man ... how much more evidence do you need? Lock him up - along with those useless crocked Commissioners and DA. El Paso County will be so much better without them!

12-55-110. Powers and limitations.
(4) No notary shall sign a certificate or other statements as to a notarial act to the effect that a document or any part thereof was attested by an individual, unless:
(a) Such individual has attested such document or part thereof while in the physical presence of such notary; and...

12-55-111. Journal.
(1) Every notary public shall keep a journal of every notarial act of the notary and, if required, give a certified copy of or a certificate as to any such journal or any of the notary's acts, upon payment of the notary's fee.

12-55-116. Official misconduct by a notary public - liability of notary or surety.
(1) A notary public who knowingly and willfully violates the duties imposed by this part 1 commits official misconduct and is guilty of a class 2 misdemeanor.

There are excerpts from the actual statutes. Notarizing stuff that was not signed in your presence, and not keeping a journal, are class 2 misdemeanors, which are criminal offenses for which you can be arrested.

Glad this article is coming out. I have been saying for some time that Bill Elder is far more corrupt and inept than Terry Maketa ever was. He just seems to think he can do anything he wants, whether legal or ethical or not and, so far, he's been able to do so because most media organizations in the area turn a blind eye to it. The Independent is the only one that seems to report some of it. Elder is so bad that current and former employees have built the www.DirtyElder.com website to air his dirty laundry, but still many don't seem to pay attention. This guy is BAD!!!
