Sure Chagoya's trite effort is art. The galleries are filled with comparably childish stuff.

The hypocrisy & double standards in the art community are infinitely more of a problem than the professor's petty posturing. The art community is doing what it always does when the issue of public art funding is raised. Their hysterical screams of 1st amendment violations are irrelevant. There's little demand to restrict Chagoya's free speech. The overwhelming objection is the use of public money to fund art that makes a conspicuous religious statement.

It doesn't take a constitutional wizard to see the real 1st Amendment implications of "Misadventure." The ACLU should have filed to have the exhibit shut down the day it went up. Taxpayers who are forced to fund religious statements of any kind are the ones who should complain that their 1st amendment rights have been compromised. It's as serious a violation of the 1st Amendment to force one person to support a particular form of religious expression as it is to restrict speech wholesale.
