Maketa retrial set for October

On July 11, a jury found former El Paso County Sheriff Terry Maketa not guilty of tampering with a witness/victim and conspiracy to commit tampering, both felonies; and one count of first-degree official misconduct, a misdemeanor. But the jury hung on charges of extortion and conspiracy to commit extortion, both felonies; and two counts of first-degree official misconduct. Now, KKTV reports, Maketa will be retried Oct. 3 on those four charges.

Former Undersheriff Paula Presley, charged with the same offenses originally filed against Maketa, was due to be tried on the same date, Oct. 3, at last report.Former Commander Juan "John" San Agustin, charged with second-degree kidnapping and false imprisonment, is slated for trial in November, though those same charges against Maketa were dropped before his trial began in late June.

After Fourth Judicial District Attorney Dan May declined to prosecute Maketa's case, citing potential conflicts of interest, it was assigned to the 18th Judicial District Attorney's Office run by gubernatorial candidate George Brauchler, though he isn't personally handling the matter.
